Customer Agreement

This Customer Agreement (“Agreement”) is entered into between Remitation Company, a company duly registered under the laws of EU, and the undersigned individual or entity (“Customer”){.
1. Services
1.1. Remitation Company agrees to provide money transfer services to Customer, facilitating connections with third-party money transfer operators and brokers.
2. Compliance with Laws
2.1. Customer agrees to comply with all applicable local, state, national, and international laws, regulations, and ordinances, including but not limited to Anti-Money Laundering (AML), Counter-Terrorism Financing (CTF) regulations, and data privacy laws.
3. Source of Funds
3.1. Customer represents and warrants that the funds provided for the money transfer services originate from legal sources and will not be used for illegal activities, including fraud, money laundering, terrorism, or any other unlawful purposes.
4. Third-Party Banking Relationships
4.1. Remitation Company conducts due diligence in selecting third-party money transfer operators and brokers and maintains ongoing oversight to ensure compliance with financial regulations.
5. Data Ownership and Privacy
5.1. Customer acknowledges and agrees to the collection, processing, and sharing of personal information with third-party operators and brokers as described in the Privacy Policy of Remitation Company.
6. Audit and Security
6.1. Remitation Company will implement and maintain appropriate security measures to protect customer data and comply with regular audit requirements.
7. Dispute Resolution
7.1. Entering this agreement, the customer fully accepts the and agrees to the fact that any disputes arising from this Agreement (and from carrying on the consequential activities and obligations) shall be firstly resolved through negotiation or mediation. The negotiation should be carried out at least by sending ,via tracked post, a request for a restorative activity from the counterparty, then waiting one month from the receival of the request. After this time has elapsed, the interestedparty, if not satisfied in his/her requests, should request a friendly agreement to solve the matter via written contract. The agreement request should be made in written form and sent via tracked post. If the attempt of reaching a friendly and cooperative agreement will fail then the party which is still not satisfied should address (here an arbitration individual or counsel should be identified). Only after, can the interested party make recourse to the law to solve the matter, under the laws of Germany.{Excluding the recourse to the law is not admissible- of course we can write it but an average lawyer may have the disposition totally voided}
8. Liability
8.1. Remitation Company shall not be liable for any loss, damage, or delay caused by circumstances beyond its control
Some examples or by the actions of third-party operators and brokers.
9. Termination
9.1. Remitation Company reserves the right to terminate this Agreement if it suspects any breach of its terms or legal violations by the Customer. The termination will be valid if communicated via… and will have full effect since.,
10. Governing Law
10.1. This Agreement shall be governed by and construed in accordance with the laws of [Our Jurisdiction].
11. Entire Agreement
11.1. This Agreement constitutes the entire agreement between Remitation Company and the Customer and supersedes all prior agreements and understandings.
12. Modification
12.1. This Agreement may be modified only in writing and signed by both parties. Amendments may be made to adhere to changes in laws and regulations with adequate notice to the Customer.
13. Direct Interaction with Third-Party Agents
13.1. The customer, by using/downloading remitation, attributes to remitation the right of seeking compensation in case the customer uses the same intermediaries to which the customer has been connected via the usage/download of remitation
13.2. Remitation Company shall bear no responsibility or liability for any outcomes, disputes, losses, or damages arising from the Customer’s direct interactions with third-party agents.
13.3. The Customer agrees to indemnify and hold Remitation Company harmless against any claims, losses, damages, or costs arising from direct engagement with third-party agents.
